TERMS OF USE

Acceptance

This Site is provided as a service to our clients and potential clients. By using this Site, you agree to comply and be bound by the below Terms of Use ("Agreement") which is a legal agreement between you and Khanijoun Intellectual Property Law (“Khanijoun IP”). In this Agreement, the terms “we” and “us” mean Khanijoun IP Law. If you do not accept this Agreement, you must not access or use a Site.

We may revise this Agreement at any time by updating this posting. Your continued use of a Site after changes are posted signifies your unconditional acceptance of the revised terms. 

Not Legal Advice

Information on the Website is for general purposes only and should not be considered legal advice. Consult a legal professional for specific concerns.

No Lawyer-Client Relationship

Your use of any Site does not create a lawyer-client relationship between you and any Khanijoun IP professional. Unsolicited emails from non-clients do not establish a lawyer-client relationship and may not be treated as confidential.  

Consultation Bookings

The Site may allow users to book paid consultations online. By booking a consultation, you acknowledge and agree to the following:

1. No Lawyer–Client Relationship
   Booking a consultation does not create a lawyer–client relationship. Legal advice can only be provided after a conflict check is completed and a formal retainer agreement is executed.

2. Subject to Review and Confirmation
   All consultation bookings are reviewed by the firm and may be declined, cancelled, or rescheduled at our discretion, including where the matter is outside our scope, availability is limited, conflict exists or other reasons. In these instances, the firm does not charge a cancellation fee, but payment processor fees or fees outside our control may not be refundable. 

3. Fees and Payment
   Consultation fees are payable at the time of booking. Fees cover the time reserved and any preliminary review. Payment processor fees are outside our control and may not be refundable in the event of cancellation.  

4. Credit
   If the firm is retained following the consultation, a portion of the consultation fee may, at the firm’s discretion, be credited toward future legal services. Any such credit will be confirmed.

5. No-Show Policy
   If you do not attend the scheduled consultation without providing at least 24-hours notice, the consultation fee will not be refunded. 

6. Rescheduling
   You may request to reschedule in advance, subject to availability. The firm may also request to reschedule if necessary.

7. Scope of Consultation
   Consultations are intended for preliminary discussion only and do not include document drafting, filings, legal opinions, or substantive legal work unless separately agreed upon within a formal retainer.

Communication

We make every effort to safeguard the information of our clients including using appropriate technology and physical locks. As you can appreciate, Internet communications may not be secure, and we cannot ensure the security or privacy of any communication transmitted through the Site.

Website Availability and Security

We do not guarantee that the Site will be available, uninterrupted, error-free, or free of harmful components. You use the Site at your own risk. We are not responsible for any damages arising from interruptions, errors, security breaches, viruses, or other harmful elements encountered during your use of the Site. 

Privacy Notice

Khanijoun IP treats personal information submitted through the Website according to its Privacy Notice. By using the Site or providing personal information, you consent to the use of your information by Khanijoun IP as provided in the Privacy Notice.

Ownership of Content and No Reproduction

The content on this website is owned by Khanijoun IP Law or others who have allowed the use of the content. Your use of the Sites does not grant ownership or other rights in the Site or content within it. Any rights not expressly granted to you in this Agreement are reserved. You may not reproduce, distribute, publish, modify, or create derivative works from any content on the Site without our express written permission. 

Limited Licence

Subject to the terms and conditions of this Agreement, you are granted a limited, fully revocable, non-transferable, and non-exclusive licence to access, view, and use the Site for personal, non-commercial use. 

Links

The Site may contain links to third-party websites for your convenience. We are not responsible for the content of any third-party website and makes no representation or warranty regarding any third-party website. Our Privacy Notice applies only to our Site.

Prohibited Use

You agree not to use the Site for any unlawful purpose or in any manner that could damage, disable, or impair the Site.

Limitation of Liability

Subject to applicable law, Khanijoun IP and related parties including, but not limited to, consultants, representatives, employees, and agents (“Released Parties”) are not liable for any damages arising from your use of, or inability to use, the Sites regardless of cause, and whether arising in contract, tort, or otherwise.

Disclaimer of Warranties

Subject to applicable law, the Site and content are provided "as is" and "as available", without warranty or condition of any kind, express or implied. We disclaim all warranties and conditions to the fullest extent permissible under applicable law.

Release and Indemnity

You agree to release and indemnify Khanijoun IP and related parties from any liabilities or damages arising from your use of the Sites. You agree that your sole remedy is to cease using the Site.

Governing Law and Jurisdiction

By accessing or using a Site, you agree that all matters relating to your access or use shall be governed by the laws of Ontario.

Termination

We may cancel or terminate your right to use any Site at any time without notice. The provisions of this Agreement that impose ongoing obligations shall survive termination.

General

If any provision of this Agreement is held invalid, the remaining provisions shall remain in full force. You may not assign your rights or obligations hereunder. No waiver by Khanijoun IP of any provision shall be considered a waiver of any other provision. The headings in this Agreement are for convenience only and have no legal effect.
